Vendor Agreement
Vendor Requirements
Vendors agree to commit to the full duration of the event and to adhere to instructions and arrival & breakdown times as communicated by Stay Arts. Vendors further agrees that their artwork, products and/or services follow Stay Art’s content guidelines.
Liability
It is strongly encouraged that vendors acquire self insurance for the event. Although all reasonable care will be taken to ensure safety during the event, Stay Arts and our partners will not be liable for any loss or damage of products by any reason, including by not limited to, theft, wear, fire, water damage or natural disaster.
Photo & Marketing Release
Vendors may be included in recordings, streaming, photographs and/or videos created during this event. Vendors agree to have their name, biography, and any written content and/or images submitted to Stay Arts used for marketing purposes. Vendor also agrees to have their name, face, likeness and appearance used in advertising and promotion related to Stay Arts.
COVID-19
Vendors acknowledge the contagious nature of COVID-19 and that an inherent risk of exposure exists in any public place where people are present. Although Stay Arts and our partners will take all preventative measures to reduce the spread of COVID-19, there may be a risk of becoming infected. Vendors are highly encouraged to wear a mask during the duration of the event and to be vaccinated and boosted.
Waiver, Release & Hold Harmless
Vendors agree to release, waive and hold harmless Stay Arts and our organization, its partners, staff, volunteers, or affiliates from all liability, claims, penalties, costs, losses, damages, expenses or judgements resulting from illness, injury, death or damage from participation in this event. These terms of service are governed by the laws of California. Any disputes arising from or relating to these terms shall be resolved through arbitration in accordance with the rules of California.
