Vendor Agreement

Vendor Requirements

Vendor agrees to commit to the full duration of the event. Vendor further agrees that their artwork, products and/or services follow Stay Gallery’s content guidelines.

Liability

  • It is strongly encouraged that vendors acquire self insurance for the event. Although all reasonable care will be taken to ensure safety during the event, Stay Gallery will not be liable for any loss or damage of products by any reason, including by not limited to, theft, wear, fire, water damage or natural disaster.

  • Upon your attendance of this event, please be mindful of the gallery space and artwork. We kindly ask that you do not touch the displayed artwork or lean anything on the gallery walls (including yourself, products, equipment, etc.). You understand that you will be liable for any damage to the space and/or the artwork caused by you or anyone under your supervision.

Photo Release

Vendors may be included in recordings, streaming, photographs and/or videos created during this event. Vendor agrees to have their name, biography, and any written content and/or images submitted to Stay Gallery used for marketing purposes. Vendor also agrees to have their name, face, likeness and appearance used in advertising and promotion related to Stay Gallery.

COVID-19

Vendor acknowledges the contagious nature of COVID-19 and that an inherent risk of exposure exists in any public place where people are present. Vendor further acknowledge that although Stay Gallery has taken all preventative measures to reduce the spread of COVID-19, there may be a risk of becoming infected as a result of the actions or negligence of themselves and others.

Waiver, Release & Hold Harmless

Vendor agrees to release, waive and hold harmless Stay Gallery and its respective departments, partners, sponsors, directors, officers, representatives, members, agents, contractors, subcontractors and employees (hereinafter collectively “Stay Gallery”) from all liability, claims, penalties, costs, losses, damages, expenses or judgements (including attorney’s fees and costs) resulting from illness, injury, death or damage to themselves (Vendor), any visitor, third parties or personal property of any kind in any way connected directly or indirectly to the vendor’s visitation and/or use of Stay Gallery, whether caused by Stay Gallery’s active or passive negligence or otherwise.
